This course will provide a thorough study of the essentials of Canadian patent law and practice. Topics covered will include the basic nature of patents, the historical development of the patent system, the statutory framework, the relationship between patents and other forms of intellectual property, the criteria for obtaining a patent, the application process, the contents and interpretation of a patent, the scope of protection afforded by a patent, the exploitation and enforcement of patent rights, patent litigation, available remedies, the application of patent law in specific industries such as pharmaceuticals, and international patent law comparisons. It is expected that at the end of the course students will have solid understanding of patent law and practice to confidently base a decision to pursue this area of the law in practice as well as be well versed with patent issues that might arise in any practice of law.
